Regarding divorce and reconciliation, 1920

Mirza ‘Ali Akbar, Shaykh al-Islam from Sarab, writes: “about a month ago, Aqa Mirza Kazim, the money changer (sarraf) from Sarab, came to me and claimed that several months earlier, he had divorced his wife (upon her request, a khul’ divorce), and that before the expiration of her ‘iddah, they had reconciled. Aqa Mir ‘Abd Allah, representing his sister, came and denied Aqa Kazim’s claim. In order to ascertain the veracity of my action, and with the consent of both sides, I telegraphed and asked for written permission from Aqa Haji Mirza Khalil Aqa, the mujtahid. Aftr I received his permission, I asked the two sides to come and conducted my own investigation. First, Aqa Mirza ‘Abd Allah’s sister [Aqa Kazim’s disputed wife], with Aqa Mirza ‘Abd Allah as her legal representative, testified and denied Aqa Kazim’s claim. Then, Aqa Kazim produced a signed document, in the handwriting, and with the seals of, Imam Jum’ah and Aqa Mirza ‘Ali Muhammad Kandi, testifying that on the 17th of Muharram, Aqa Mirza ‘Abd Allah’s sister had returned to her husband, Aqa Kazim, of her own volition and with her mahr. Because I could not be certain, I asked for more testimony. Several men and women swore to the veracity of Aqa Kazim’s claim. So according to the consensus of the ‘ulama, I asked Aqa Kazim to also swear and then take back his wife. Then, Aqa Kazim’s older brother, Karbala’i ‘Ali Asghar, the sarraf, and Aqa Mir ‘Abd Allah asked me to grant a 20-day period of separation in which they would attempt a reconciliation among themselves. But it was then revealed that Aqa Mir ‘Abd Allah had deceived us, and without my or Aqa Kazim’s knowledge, had acquired [contrary] letters of permission from Mirza ‘Abd Allah and Shaykh Riza. I state here that the shar’i testimony concerns Aqa Kazim’s swearing that would permit him to take back his wife.”
